Terms of Service

1. Who we are
Tokloom (the “Service”) is operated from Bangladesh (“we”, “us”, “our”). The Service is accessed at tokloom.com. By creating an account or using the Service you agree to be bound by these Terms.
2. The Service
Tokloom is a TikTok content-automation tool. It sources images for the niches and keywords you choose, generates captions (and, for some content types, video) with AI, stitches them into short slideshow or video posts, and publishes them to the TikTok account(s) you connect, on the schedule you configure. You decide the niches, keywords, content settings, and posting cadence; the Service acts on your behalf according to those settings.
3. Eligibility and accounts
You must be at least 18 years old to create an account and use the Service. Tokloom is intended for adults, including content creators, marketers, dropshippers, and businesses. It is not directed to, or intended for use by, anyone under the age of 18. You sign in with Google; you are responsible for keeping your Google account secure and for all activity that occurs under your Tokloom account. You must provide accurate information and keep it up to date.
4. Acceptable use
You agree not to:
- Generate or publish content that is illegal, infringing, defamatory, or harmful;
- Source, upload, or publish images or material you do not have the right to use;
- Use the Service to spam, mislead, impersonate others, or run deceptive campaigns;
- Attempt to reverse-engineer, scrape, or overload the Service or its infrastructure;
- Resell or sublicense access to the Service without our written permission;
- Use the Service in any way that breaches applicable law or the TikTok Terms of Service or Community Guidelines.
We may suspend or terminate accounts that violate these terms, with or without notice, at our reasonable discretion.
5. Subscriptions and payment
Tokloom offers paid plans (Starter, Growth, Scale, and Enterprise) with monthly video and automation limits shown on the Pricing page. Paid subscriptions are sold and processed through Polar.sh, which acts as the Merchant of Record for all transactions. Polar’s own terms apply in addition to ours at checkout.
Paid subscriptions do not auto-renew. Each subscription is billed once at the start of its period and expires automatically at the end of that period. To continue paid access, you must re-subscribe through the Pricing page. You will not be charged again unless you actively go through checkout a second time.
Prices, plan benefits, and usage caps may change. We will give reasonable advance notice via email or in-app notice for material changes. Changes take effect at the next purchase cycle and never retroactively for an already-paid period.
6. TikTok and third-party platforms
When you connect a TikTok account, you authorize us to publish content and read post statistics on your behalf through TikTok’s API, strictly according to the automations you configure. You are responsible for ensuring you own or are authorized to manage each connected account and that your content complies with the TikTok Terms of Service and Community Guidelines.
The Service also depends on third parties including TikTok, Pexels and Pinterest (image sourcing), Google and Anthropic (AI), Replicate (AI video), Supabase, Polar, and Resend. We are not responsible for changes, outages, or actions taken by these platforms, including TikTok content removal or account actions. You are solely responsible for ensuring you have the rights to any images or content surfaced by your automations.
7. Refunds
We do not offer discretionary refunds. However, statutory consumer rights (including the EU 14-day right of withdrawal and the UK Consumer Rights Act 2015) are honored automatically by Polar where they apply. Because subscriptions do not auto-renew, you are never billed for a period you did not actively purchase.
8. Your content
You retain all ownership of the content you create and generate (your niches, keywords, captions, sourced images, and generated videos). By using the Service you grant us a limited, non-exclusive license to process this content solely for the purpose of providing the Service to you (sourcing images, generating captions and videos, publishing to TikTok, and reporting analytics). We do not use your content to train any AI models.
9. AI-generated content
The Service uses third-party AI models to generate captions, scripts, and video. AI output may contain inaccuracies, omissions, or misinterpretations, and you are responsible for reviewing and editing anything published to your accounts. You should not rely on AI-generated output for medical, legal, financial, or other professional advice, and you are responsible for ensuring published content complies with TikTok’s policies and applicable law. Always verify important information against authoritative sources.
10. Service availability
We provide the Service on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free operation, specific reach or results, or that any particular feature will remain available. We may perform maintenance, change features, or discontinue parts of the Service at any time.
11. Termination
You may delete your account at any time from your account settings. Account deletion cascades to all of your data — connected TikTok accounts (including stored access tokens), automations, posts, collections, and other records. We may terminate or suspend access if you breach these Terms or use the Service in a way that creates risk for us, for TikTok, or for other users.
12. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee views, reach, or results. Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or USD $50, whichever is greater.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of goodwill. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Tokloom and its operator from any claim, loss, or expense arising from your use of the Service, your content, or your breach of these Terms.
14. Governing law and disputes
These Terms are governed by the laws of the People’s Republic of Bangladesh, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be brought exclusively in the courts of Bangladesh, except where mandatory consumer-protection law requires otherwise (in which case the courts of your country of residence may also have jurisdiction).
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and update the “Last updated” date above. For material changes that affect your rights we will give reasonable notice (email or in-app). Continued use of the Service after the changes take effect constitutes acceptance.
